RE: The tariff classification of a ponytail holder, from Taiwan.

Dear Ms. Balice:

In your letter dated July 29, 2002, you requested a tariff classification ruling. The instant sample, style 69272, and described as a “tinsel pony tail holder”, consists of an elastic textile covered rubber cord. There appears to be metalized plastic strips, which meet the tariff definition of man-made fiber textile strips. These strips, which measure under 5 mm in apparent width are affixed to the cord via yarn and/or metal wire and create the tinsel-like affect. The applicable subheading for the product will be 5609.00.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of yarn, strip or the like of heading 5404 or 5405, … not elsewhere specified or included, of other than cotton, vegetable fibers, or man-made fibers. The rate of duty will be 4.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
